Acceptance of Terms of Usage
These Terms of Usage govern your access and use of this Site. By accessing or using this Site you agree to be bound by these Terms of Usage and to any additional guidelines, restrictions, or rules that may be posted in connection with specific sections or services of this Site. All such additional posted guidelines, restrictions, or rules are hereby incorporated by reference into these Terms of Use.
ASE Marketing Group, Inc. reserves the right to make changes to this Site and to these Terms of Usage at any time without prior notice. You should review these Terms of Usage each time you access this Site.
You also agree that we may provide all legal communications and notices to you electronically by posting them on our website or, at our election, by sending an e-mail to the e-mail address you provided to us when you registered at our website. You may withdraw your consent to receive communications from us electronically by contacting customer care. However, if you withdraw your consent to receive our communications electronically, you must discontinue your use of your account.
General
All the terms and conditions and/or any transactions occuring online aseprints.com, asepromos.com or www.asemarketing.com or by phone are subject to the laws of the State of California. ASE Marketing Group, Inc. is not responsible for the delay and/or damages resulting from Machinery Breakdown, Acts of God, and from other actions, both governmental and otherwise, including but not limited to war, riot, seizure, and embargo. The tools available on aseprints.com, asepromos.com or www.asemarketing.com www.asemarketing.com to create document is the property of ASE Marketing Group, Inc. and its affiliated companies. The Buyer’s order shall be deemed an acceptance of the Seller's terms. The Terms and conditions shall in all respects be governed by STATE OF CALIFORNIA law.
Reservations
All orders are subject to acceptance by ASE Marketing Group, Inc.. We reserve the right to reject any order at any time without recourse. We also reserve the right to change the price at any time even after we receive the order.
Returns
Due to the nature of the product, no returns can be made once the order is processed and/or shipped. Any claims for defects, damages, or shortages must be made in writing within two (2) business days after receipt of the merchandise. We will replace only those orders that were processed incorrectly. The replacement of the order will take place only after the receipt of returned merchandise. We will not replace the order if it is determined by us that the order was misused or mishandle by the buyer or part of the order was used by the buyer and part of the order is being returned.
Custom projects with value over $200 dollars will not qualify for returns on material or labor used to produce the project. If cancelled, for any reason, all cost of materials and labor used will be non-refundable.
Credit Card
If the Buyer's credit card is declined, ASE Marketing Group, Inc. will not process the Buyer’s order. If the order is shipped and should the Buyer's account become delinquent, Buyer agrees to pay a monthly finance charge of 2% (annual percentage rate of 24%) on the unpaid balance. If an account goes beyond the payment term's due date, unless specific arrangements are made, future purchases will require advance payment. In the event that ASE Marketing Group, Inc. must commence legal action to enforce any terms of this agreement, the Buyer agrees to pay reasonable legal fees and costs.
Warranty
ASE Marketing Group, Inc. neither makes any explicit warranty nor imply or accepts any responsibility other than possible replacement of the products that Buyer is buying. ASE Marketing Group, Inc. may but does not guarantee the replacement of the defective product, or credit the amount of the purchase price.
Shipping
Shipping terms are F.O.B. ASE Marketing Group, Inc. will arrange for shipping with the carrier on behalf of the buyer. The Buyer will be fully responsible for the shipping and handling cost. ASE Marketing Group, Inc. will not be responsible for the delay in delivery, loss or damage of the order while the order is with the shipping carrier. Any additional shipping charges assessed by the carrier will be charged to the payment method used for the transaction purchased. Our turnaround times refer solely to production. Once production is complete it may take up to one business day for orders to ship or be available for pick-up.
Any additional shipping charges not applied at time of checkout will be charged to the payment method for the transaction.
Any return or exemption of package delivery, including updated/changed addresses will result in a $25 charge to payment method used at time of checkout.
Please be sure the shipping address is correct. Any returned items due to incorrect address or failed delivery attempts will result in a $25 charge per package returned. Any additional reshipment costs will be billed as well.
Limitation of Liability:
ASE Marketing Group, Inc. will not be liable in contract or in tort (including negligence) to the customer for incidental or consequential damages, arising out of or resulting from anybody’s performance or nonperformance of our obligations. ASE Marketing Group, Inc. shall not be liable to anyone for any kind of financial losses, cost, expenses, damages and/or other economic damages. The Buyer agrees that the Buyer will not hold ASE Marketing Group, Inc. responsible for any and all loss, cost, expense, and damages (including legal costs) on account of any and all manner of claims, demands, actions, and proceedings that may be instituted against ASE Marketing Group, Inc. and its affiliated company(S) on grounds alleging that the said work violates any copyrights, trademarks, service marks, or is scandalous, or invades any person's right to privacy or other personal rights.
Cancellations and Refunds:
ASE Marketing Group, Inc. will not refund any money for the orders that were shipped, delivered or were cancelled after the order being processed for, during or after production. All materials, labor and proofs will be due at 100% value.
Orders will not be refunded to do delivery delays as we can not gaurantee production time or delivery times with Covid19 and other Pandemic related issues.
Specials & Promotions:
ASE Marketing Group, Inc. specials and promotions may have unstated restrictions and limitations depending on products/services ordered. No discounts apply to Direct Marketing campaigns.
Graphic Design
Graphics Design Services: It is agreed that the fee for service shall be the cost estimates provided via email or verbal, unless work undertaken exceeds work outlined. If work undertaken exceeds the items specified in the quote, "The Client" agrees to pay appropriate fees for the excess work, outside the scope of the original agreement. Wherever possible the client will be notified of increases in the scope of the project. Excess Work: This is defined as any work involving additions to the list of items defined in the Project Proposal or changes to all pieces of finished artwork after sign off by an authorized representative of "The Client". Changes to any Supplies completed (Author's corrections) or part completed requested by the client or any other part beyond our control, will be charged to the Client on a time basis at of $85. Should additional design not initially quoted for be requested during the design process, a progress payment will be payable prior to further work being carried out. Otherwise, all additional costs will be added to the final invoice, payable prior to delivery of design files, in which case the additional costs will be paid for using the payment form on file. Publication and/or release of work performed on behalf of the client by ASE Marketing Group, Inc. / ASE Print & Graphics may not take place before cleared funds have been received. Any booking fees, delivery fees, design commencement fees, or progress payments are non-refundable once work has commenced. ASE Marketing is not responsible for content.
Direct Mail Processing & Tax Exemption Agreement:
Direct Mail Processing and Print Materials: Direct Marketing, Direct Mailing Fee.
SUPPORTING DOCUMENTATION. Any seller claiming an exemption for the sale of printed sales messages must obtain and retain supporting evidence of the delivery of the property.
(1) Delivery by the Seller. A seller who mails exempt printed sales messages through the United States Postal Service or by common carrier, should obtain and retain U.S. Postal receipts or bills of lading and obtain and retain a timely exemption certificate, taken in good faith, from the purchaser. The exemption certificate should be similar to the following:
"I hereby certify and agree that the items purchased are printed sales messages and that the printed sales messages described herein which I shall purchase from ASE Marketing Group, Inc. will be delivered by the seller or the seller's agent through the U.S. Postal Service or by common carrier at no cost to another person who becomes the owner of the printed material. If any of such printed material is delivered other than as specified above, I understand that I am required by the Sales and Use Tax Law to report and pay tax, measured by the purchase price of such property. Description of property to be purchased: Printed mailing material and Direct Marketing Services."
Color Quality
ASE MARKETING GROUP, Inc., ASE PRINT & GRAPHICS AND ASE PROMOS guarantees that its prints will meet CMYK industry standards. We cannot guarantee "match-print" color fidelity and cannot prevent slight color shift throughout an order. Because we cannot control the color reproduction of a customer's computer monitor, we cannot guarantee that the actual print color will precisely match any preview as it appears your monitor. ASE MARKETING GROUP, Inc., ASE PRINT & GRAPHICS AND ASE PROMOS is not responsible for any color shift in converted photographs (RGB images) with black, near black, or gray tones. Color shifts from a perceived black or gray must be addressed prior to file submission. Proofs do not guarantee black, near black or gray final output. Please note that the application of UV coating may have an effect upon or change the appearance of printed colors. ASE MARKETING GROUP, Inc., ASE PRINT & GRAPHICS AND ASE PROMOS is not liable for the final color appearance of a UV coated product.
Governing Law
The Site Terms and your use of this Website shall be governed by and construed in accordance with the laws of the State of California, without resort or giving effect to conflict of law provisions. Regardless of where you access this site, you agree that any action at law or in equity arising out of or relating to these Site Terms and/or your use of this Website shall be filed and adjudicated only in the federal or state courts located in Los Angeles, California, and you hereby irrevocably and unconditionally consent and submit to the exclusive jurisdiction and venue of such courts over any suit, action or proceeding arising out of or under these Site Terms and or your use of this Website. This Agreement is not governed by the United Nations Convention of Contracts for the International Sale of Goods, the application of which is expressly excluded.
INDEMNIFICATION
You agree that you shall indemnify and defend and hold ASE MARKETING GROUP, Inc., ASE PRINT & GRAPHICS AND ASE PROMOS and its officers, directors, employees, shareholders, agents, affiliates, subsidiaries, suppliers and representatives, harmless from and against any and all claims, damages, losses, costs, and expenses (including but not limited to attorneys' fees) that, directly or indirectly, arise out of or are related to: (i) your breach of any provision of the Site Terms; (ii) any suit, claim, or demand arising from or relating to an allegation that any Customer Content provided by You, or any other text, photograph, image, graphic or other material you incorporated into products or services ordered from this ASE MARKETING GROUP, Inc., ASE PRINT & GRAPHICS AND ASE PROMOS, that was not part of the standard Site Contents, infringes up the rights of a third party (iii) and/or (c) any of your activities conducted in connection with this Website, your use thereof, and/or the products and services ordered through this Website.
TERMINATION
ASE MARKETING GROUP, Inc., ASE PRINT & GRAPHICS AND ASE PROMOS may suspend or terminate your account and or your right to utilize the services made available through this Website in the event that it determines or has reasonable grounds to suspect that you are in violation of the Site Terms.
Notwithstanding any of these Site Terms that may suggest otherwise, ASE MARKETING GROUP, Inc., ASE PRINT & GRAPHICS AND ASE PROMOS reserves the right, without notice and in its sole discretion, to terminate your right to use this Website for any reason or no reason at all, and to block or prevent future access to and use of this Website by you. In the event your right to use this website is terminated, these Site Terms shall still apply.
We reserve the right to refuse service to anyone.
Blank Items ordered
ASE MARKETING GROUP, Inc., ASEPRINTS.COM AND ASE PROMOS will not honor refunds of blank apparel or blank promotional items once the item(s) is shipped.
Due to unavoidable supply chain disruptions, all apparel and promotional orders will be delayed by 15 - 20 days.
